RESUMEN

Aunque el sistema de reparto en León seguía siendo igualitario, en este artículo tratamos de averiguar las estrategias y bienes que quedan al margen de las legítimas. Así, por una parte, las familias de la burguesía comercial y financiera de la ciudad de León recurrirán a mecanismos legales, permitidos por la legislación castellana (mejoras y mandas), pero también a prácticas propias de la profesión con el objetivo de amortiguar el igualitarismo y en definitiva concentrar más cantidad en valor y bienes, en general más conectados con el negocio, en los hijos elegidos previamente. En este sentido, no hay que olvidar las estrategias presucesorias (la preherencia) donde no sólo entran en juego aspectos económicos, difíciles de cuantificar, sino también la transmisión de unos importantes saberes (capital “simbólico”) que atenúan de nuevo el igualitarismo hereditario. Y por otra parte, el campesinado de la comarca de Sahagún destinará bienes para sufragar los gastos de su muerte y sobre todo para lograr la salvación de su alma, los cuales escaparan también a las legítimas de los hijos.

ABSTRACT

Although the system in inheritance in Leon continued been egalitarian, in this article we would like to find out the strategies and goods which were not included in the part divided in accordance with the law. One hand the families of comercial and financial burgeois in the city of León resorted to using legal mechanisms (“mejoras” and “mandas”). They also resorted to other types of practices that reduced egalitarian inheritance but tey favoured the sons most closely connected to the family business giving them a larger quantity of the goods and money. Before the sons receiving the inheritance, the father imparts important knowledge of the family business to their previously selected sons. On the other hand, in Sahagún and its area, the peasants class set goods aside to cover funeral expenses. An pay for masses to save heir soul.
